The Age of Consent
MCL 750.520d — 16, and third degree criminal sexual conduct below it
A person commits criminal sexual conduct in the third degree by sexual penetration with another person who is at least 13 years of age and under 16 years of age. That makes 16 the line this section draws.
Who handles this in Michigan: State Bar of Michigan Lawyer Referral Service; and legal aid programs and the state offices, listed in the Michigan directory.
A felony of up to 15 years. Criminal sexual conduct in the third degree is a felony punishable by imprisonment for not more than 15 years.
The same section reaches other situations at any age, among them force or coercion, a person the actor knows or has reason to know is mentally incapable or physically helpless, and school and child care staff with a student or resident who is at least 16.
Other degrees of criminal sexual conduct, registration and the consequences of a conviction are in other sections not covered here. A charge, or the worry of one, is a question for a licensed Michigan attorney.
