When Police Are Called To A House
MCL 764.15a — arrest without a warrant for a domestic assault, whether or not in the officer's presence
Without a warrant. A peace officer may arrest an individual for domestic assault or aggravated domestic assault, whether or not the officer has a warrant or saw it, if the officer has or receives positive information that another peace officer has reasonable cause to believe the violation occurred or is occurring.
The relationship. The individual has a child in common with the victim, lives or lived in the same household, has or had a dating relationship with the victim, or is a spouse or former spouse.
Dating. A dating relationship means frequent, intimate associations primarily characterized by the expectation of affectional involvement, and does not include a casual relationship or ordinary fraternization in a business or social context.
