Working With A Record
MCL 37.2205a — no request or record about a misdemeanor arrest that did not end in conviction
Misdemeanor arrests. An employer, employment agency or labor organization, other than a law enforcement agency, may not request, make or keep a record of information about a misdemeanor arrest, detention or disposition that did not result in a conviction, in connection with an application or the terms of employment.
Not perjury. A person is not guilty of perjury or a false statement for leaving out information the section gives a right to withhold. The section does not cover a felony charge before conviction or dismissal.
Federal rules on background check reports, and the jobs where a law requires a check, are set out elsewhere and are not on this page. Whether a particular employer followed the law is a question for the state's civil rights or labor agency, or a licensed Michigan attorney.
