Minn. Stat. 609.224 — fifth-degree assault is a misdemeanor
Fear or harm. An act done with intent to cause fear in another of immediate bodily harm or death, or intentionally inflicting or attempting to inflict bodily harm on another, is fifth-degree assault, a misdemeanor.
It is a gross misdemeanor, up to 364 days, a $3,000 fine, or both, against the same victim within ten years of a previous qualified domestic violence-related conviction, or against anyone within three years of one.
