Minn. Stat. 169A.20 — a crime to drive, operate, or be in physical control of a motor vehicle while impaired

Physical control. It is a crime for any person to drive, operate, or be in physical control of a motor vehicle in Minnesota, or on any boundary water of the state, while under the influence of alcohol, a controlled substance or an intoxicating substance, or a combination of them.

The two hours. The same is true when the alcohol concentration at the time, or as measured within two hours of the time, of driving, operating or being in physical control is 0.08 or more, or 0.04 or more in a commercial motor vehicle.

Whether a person parked with the engine off, or asleep in the seat, was in control of the vehicle is decided on the facts of the case, and is a question for a licensed Minnesota attorney.
