Minn. Stat. 169A.33 — any physical evidence of drinking in the body is a misdemeanor under 21
Any evidence of drinking. It is a crime for a person under the age of 21 years to drive or be in physical control of a motor vehicle while drinking, or after drinking while there is physical evidence of it in the person's body. It is a misdemeanor.
On the court's finding, the commissioner suspends the license for 30 days, or for 180 days after a previous violation. Where the conduct is also driving while impaired, the impaired driving penalties and license sanctions apply instead.
