Getting Divorced
Mo. Rev. Stat. § 452.305 — ninety days' residence, thirty days after filing, and irretrievably broken
- One spouse has lived in Missouri, or been stationed there with the armed services, for the ninety days before filing.
- Thirty days have passed since the petition was filed.
- There is no reasonable likelihood the marriage can be preserved, so it is irretrievably broken.
- The court has provided for custody and support of the children, maintenance, and the property.
When those are found, a Missouri court enters a judgment of dissolution. If the court finds a reasonable likelihood the marriage can be preserved, it enters a judgment of legal separation instead. Pregnancy does not prevent either.
