Helping At The Scene

Mo. Rev. Stat. § 537.037 — the Good Samaritan law, for the licensed and the trained

In Missouri, the section protects licensed physicians, nurses and emergency medical technicians who in good faith render emergency care without compensation at the scene of an emergency or accident, and any other person trained in first aid in a recognized program who renders care, without compensation, to the level of that training. None of them is liable for civil damages except for gross negligence or willful or wanton acts or omissions.

  • A licensed physician or nurse may give emergency care to a minor at the scene without first getting a parent's consent.
  • Any person may, without compensation, render suicide prevention interventions at the scene of a threatened suicide with the same protection.
  • The section's emergency care protection is written for the licensed and the trained, and does not name an untrained bystander.

The protection is from civil liability, a lawsuit for damages, and the section sets its own limits on who and what it covers. Whether it applies to a particular act is a question for a court and for a licensed Missouri attorney.
