Under 21 And Driving

Mo. Rev. Stat. § 302.505 and § 577.020 — two hundredths of one percent is enough under 21

Two hundredths of one percent. A driver under twenty one who is stopped may be asked for a chemical test when the officer has reasonable grounds to believe the driver had a blood alcohol content of two hundredths of one percent or more by weight.

The Department of Revenue suspends or revokes the license of a driver who was under twenty one when stopped on probable cause of driving at or over that level, as it does for any driver arrested on probable cause of driving at eight hundredths of one percent or more. Its decision is final unless a hearing is requested and held, and it stands apart from whatever happens to the criminal charge.
