A Sale at the Door
MCA 30-14-504 — cancel until midnight of the third business day after signing, and the money back within 10 days
A buyer may cancel a personal solicitation sale until midnight of the third business day after signing the agreement. Cancellation is a written notice to the seller, effective when mailed, in any form that shows the buyer does not intend to be bound.
Who handles this in Montana: legal aid programs, lawyer referral and the state offices, listed in the Montana directory.
- The seller gives the buyer a notice of the right to cancel, and the 3 days run only from when that notice is given.
- Until the seller does, the buyer may cancel in any manner and by any means.
- Goods that cannot be returned in substantially the same condition cannot be canceled.
Within 10 days after a cancellation, the seller returns every payment and any note. A seller who refuses is liable for the whole down payment, and a buyer who wins in court also gets $500 plus attorney fees.
