Counting a Deadline
MCA 1-1-306 — leave out the first day, count the last, and a last day on a Saturday or holiday moves to the next business day
Time to do anything the law requires is counted by leaving out the first day and including the last, unless the last day is a holiday, in which case it is left out too.
Who handles this in Montana: legal aid programs, lawyer referral and the state offices, listed in the Montana directory.
An act due by law or contract on a day that falls on a holiday or a Saturday may be done on the next business day with the same effect.
Sunday is a holiday. Every Sunday is a legal holiday, along with the named holidays and state general election day. A named holiday on a Sunday moves to the Monday after, and one on a Saturday to the Friday before.
