Littering and Dumping
MCA 75-10-212 — no garbage, dead animals or debris on a road or within 200 yards of one
No one may dump or leave garbage, a dead animal, or other debris or refuse on any highway, road, street or alley, on any public property, within 200 yards of a public road or public property, or on private land open for hunting, fishing or recreation without the owner's consent.
Who handles this in Montana: State Bar of Montana, Licensed Lawyer Montana; and legal aid programs and the state offices, listed in the Montana directory.
A person who does is absolutely liable, meaning no proof of intent is needed, and faces the civil penalties set in another section not covered here. Whether a particular complaint fits is a question for a licensed Montana attorney.
