Renting The Lot, Owning The Home

Neb. Rev. Stat. § 76-1490 — sixty days' notice of a rent increase, a sale at the owner's price, and no retaliation

Sixty days. Each tenant is notified in writing of any rent increase at least sixty days before the effective date of the increase.

New or changed park rules take sixty days' notice too, unless an adult from at least sixty percent of the households consents in writing.

The landlord makes the repairs needed to keep the park fit and habitable, keeps the common areas clean and safe, removes garbage, and furnishes outlets for the utilities provided.

  • No entrance or exit fee of any kind, unless for services actually rendered or under a written agreement.
  • A resident may sell the home at a price of their own choosing after giving notice, and the landlord has ten days to approve or disapprove the buyer as a tenant.
  • The landlord may not unreasonably refuse or restrict that sale.

A tenant may end the agreement on written notice of at least thirty days for a breach affecting health and safety, if it is not remedied or reasonable steps are not taken in fourteen days.

A landlord may end the agreement for a material breach on written notice of at least thirty days, unless the breach is remedied in time, or for rent left unpaid seven days after written notice.

No retaliation. A landlord may not raise the rent, cut services, or bring or threaten an action for possession after a good faith complaint to a code agency, a complaint to the landlord, or joining a tenants' union.

Rent in default five days after it is due is an exception to the retaliation rule. A particular park is a question for a licensed Nebraska attorney.
