The Fence Between Neighbors

Neb. Rev. Stat. § 34-102 — each neighbor builds and keeps up a just proportion of the division fence

A just proportion. Adjoining landowners each build and maintain a just proportion of the division fence between them, either their share of the fenceline or an equitable contribution to its cost.

Unless the statute or an agreement says otherwise, the allocation is an equal burden. Neither neighbor is compelled to put up a fence if neither wants one.

An action to recover title or possession of land can only be brought within ten years after the claim arises.

Unless the neighbors agree otherwise, the fence is a wire fence as the chapter defines it. A particular boundary is a question for a licensed Nebraska attorney.
