What An Offense Class Means

Neb. Rev. Stat. § 28-105 and Neb. Rev. Stat. § 28-106 — the term and the fine for each class of felony and misdemeanor

Class W. Driving under the influence has its own class. A first conviction carries a mandatory minimum of seven days and five hundred dollars, and a maximum of sixty days; a second, thirty days to six months; a third, ninety days to one year and one thousand dollars.

An infraction is not a crime of any class. Where no other penalty is set, the first offense is a fine of not more than one hundred dollars.

A felony with a mandatory minimum is not eligible for probation. A particular sentence is a question for a licensed Nebraska attorney.
