NRS 651.075 — two questions allowed, no proof demanded, and no extra fee or deposit

  • Refuse admittance or service to a person with a disability because a service animal is with the person.
  • Refuse admittance or service to a person training a service animal, or keep an employee who is training one from bringing it to work.
  • Refuse admittance or service because a police dog is along.
  • Charge an additional fee or deposit for a service animal, a service animal in training or a police dog.
  • Require proof that an animal is a service animal or one in training.

Each of those is unlawful for a Nevada place of public accommodation. What it may do is ask whether the animal is a service animal or one in training, and what tasks it is trained or being trained to perform.

When it may be asked to leave. A business may ask that a service animal be removed if it is out of control and the person does not take effective action to control it, or if it poses a direct threat to the health or safety of others. An unmuzzled service animal may not be presumed dangerous for that reason.

Charging an extra fee or deposit makes the business liable for actual damages, punitive damages of not more than three times the actual damages and never less than $750, and reasonable attorney's fees.

The person with the animal remains liable for damage it causes and is subject to the same conditions as everyone else; a miniature horse may be refused where accommodating it is not reasonable under the federal factors. Whether a particular refusal was lawful is a question for a court and a licensed Nevada attorney.
