Living In A Nursing Home

NRS 449A.114 — 30 calendar days' written notice before a transfer or discharge, and a meeting with the administrator

30 calendar days, and the Ombudsman. Before a Nevada facility for skilled nursing, facility for intermediate care or residential facility for groups transfers or discharges a patient, it gives the patient and the State Long-Term Care Ombudsman written notice of its intent at least 30 calendar days ahead, and within 10 calendar days after that notice lets the patient and anyone the patient authorizes meet in person with the administrator to discuss it.

The notice is not required for a transfer or discharge the patient asks for, or for a transfer the patient's condition makes immediately necessary to a higher level of care. Even then, a patient is transferred only after an explanation of the need and the alternatives, unless the patient's condition requires an immediate transfer and the patient cannot understand.

  • Considerate and respectful care.
  • Refusing treatment, as far as the law permits, and being told the consequences.
  • Refusing to take part in medical experiments.
  • Privacy in the patient's program of care, and confidentiality of discussions, examinations and records.
  • Continuous care, and being told of appointments and of the need for continuing care.
  • NRS 449A.112

Every patient of such a facility has those rights. The owner or administrator may not receive anything a resident leaves them by will, or life insurance on a resident, unless the owner or administrator is the resident's spouse, guardian or next of kin.
