When You Are The Victim

NRS 178.5698 — on request, word of the defendant's release, the bail, and how the case ended

On request. On a victim's or witness's request, in writing or through an automated telephone notification system where one exists, the prosecuting attorney, sheriff or chief of police tells the victim when the defendant is released from custody before or during trial, the amount of any bail, and the final disposition of the case.

Where the offense was a felony and the offender is imprisoned, the warden notifies a victim or witness who asked in writing and gave a current address when the offender is released. After a conviction for a sexual offense or one using or threatening force against the victim, the court gives the victim, an injured person, the parents of one under 18, and the family of someone killed the forms to request that notice.

  • If an employer harasses or intimidates a victim or witness for helping, the prosecutor, sheriff or police chief intercedes on written request to minimize lost pay or benefits.
  • If a court date a victim or witness was subpoenaed to will not go ahead, the prosecutor makes a reasonable effort to say so, or provides a call-in system, and mails written notice on written request.
  • The court provides a secure waiting area away from the jury and the defendant's family and friends.
  • Property held as evidence is listed on written request and returned expeditiously when no longer needed.
  • The prosecutor tells each witness about the fee for testifying and how to get it.
