Where Nobody May Smoke
NRS 202.2483 — no smoking or vaping in indoor workplaces, restaurants, grocery stores or schools
- Child care facilities, movie theatres and video arcades.
- Government buildings and public places.
- Malls and retail establishments, and all areas of grocery stores.
- All indoor areas within restaurants.
- Without exception, school buildings and school property.
Nevada prohibits smoking in any form within indoor places of employment, including those. Smoking includes electronic smoking devices that create an aerosol or vapor.
- Casino areas where minors are already barred from loitering.
- Stand-alone bars, taverns and saloons that keep patrons under 21 out, or keep smoking in a completely enclosed area minors may not enter.
- Strip clubs, brothels and retail tobacco stores.
- Certain closed tobacco and convenience store trade shows.
- Private residences, unless used as child care, adult day care or a health care facility.
- A licensed cannabis consumption lounge, for cannabis.
Smoking is not prohibited in those places by the section, though an owner may choose to go smoke free and a county or city may adopt stricter rules. Where it is prohibited, no smoking signs are posted at every entrance and ashtrays are removed.
No retaliation. No person or employer may retaliate against an employee, applicant or customer for exercising rights under the section. Letting someone under 21 loiter where smoking is allowed in a bar is a misdemeanor for the employee and brings the bar a civil penalty of $1,000, or $2,000 for a later offense.
