N.J.S.A. 2C:35-30 — no arrest for possession found because someone sought help

In New Jersey, a person who in good faith seeks medical help for someone else's drug overdose is not arrested, charged, prosecuted or convicted for possessing or using a controlled dangerous substance, a prescription drug, drug paraphernalia or a syringe, among the other offenses the section lists, when the evidence was found because they sought help.

  • Parole or probation is not revoked based only on those offenses, though the circumstance may be considered in setting the conditions.
  • It does not limit evidence of other crimes, the seizure of contraband, or an arrest for any other offense.
