Ending Without A Conviction

ORS 475.245 — conditional discharge on a drug charge, dismissed with prejudice once, and only once

For a charge on the section's list, the court, with the consent of the district attorney and the person, may defer proceedings and place the person on probation under a probation agreement. If the person fulfills its terms, the charges are dismissed with prejudice.

No plea, and no admission. The agreement may not require a plea of guilty or no contest, and entering into it is not an admission of guilt. It does include waivers of trial rights, and restitution and any court-appointed counsel fees.

On fulfillment, the court discharges the person and dismisses the proceedings without an adjudication of guilt. It is not a conviction for the disqualifications and disabilities a conviction carries.

A person gets one discharge and dismissal under this section. On a violation of the agreement, the court may impose up to a total of 30 days in jail, or resume the case.
