Suspended Or Expelled
ORS 339.250 — never expelled for truancy, and fifth grade and below only for serious harm or a direct threat
- Conduct that poses a threat to the health or safety of students or school employees
- When other strategies to change the conduct have not worked, though never for truancy
- When the law requires it
Each district's written discipline policy limits expulsion to those three circumstances.
Fifth grade and younger. For a student in fifth grade or lower, out-of-school suspension and expulsion are limited further: nonaccidental conduct causing serious physical harm, conduct an administrator determines is a direct threat to health or safety, or where the law requires it.
