Controlled Substance Act 13 — 30 grams is a small amount
In Pennsylvania, knowingly or intentionally possessing a controlled substance without a valid prescription or other authorization under the act is prohibited. For the substances this clause covers, it is a misdemeanor punishable by up to one year in prison, a fine of up to $5,000, or both, with more after a prior conviction.
A small amount of marijuana is 30 grams, or 8 grams of hashish. Possessing a small amount of marijuana only for personal use, or distributing a small amount not for sale, is a misdemeanor punishable by up to thirty days, a fine of up to $500, or both. Thirty grams of marijuana or eight grams of hashish is a small amount.
Using, or possessing with intent to use, drug paraphernalia to take a controlled substance in violation of the act is a misdemeanor punishable by a fine of up to $2,500, up to one year, or both.
The medical marijuana program is in a separate act not set out here. Delivery, manufacture and possession with intent to deliver carry heavier penalties.
