75 Pa.C.S. 3802 — drive, operate, or be in actual physical control of the movement of a vehicle
Control of the movement. An individual may not drive, operate or be in actual physical control of the movement of a vehicle after drinking enough alcohol to be rendered incapable of safely driving, operating or being in actual physical control of its movement, or with the alcohol concentrations the section sets.
The section speaks of control of the movement of a vehicle, and does not itself define it further. Whether a person parked with the engine off, or asleep in the seat, was in control of the vehicle is decided on the facts of the case, and is a question for a licensed Pennsylvania attorney.
