18 Pa.C.S. 2706 — a threat of violence, an evacuation, and the cost of it
In Pennsylvania, the crime of terroristic threats is communicating, directly or indirectly, a threat to commit a crime of violence with intent to terrorize another; to cause the evacuation of a building, place of assembly or public transportation facility; or otherwise to cause serious public inconvenience, or terror or inconvenience with reckless disregard of that risk.
A misdemeanor of the first degree, and a felony if people are diverted. It is a misdemeanor of the first degree unless the threat causes the occupants of the building, place of assembly or transportation facility to be diverted from their normal operations, which makes it a felony of the third degree.
Communicating includes in person, in writing, and by telephone, email, the internet and similar means. On a conviction, the person also pays restitution equal to the cost of the evacuation, including the fire, police and emergency medical response.
