When The School Calls It Bullying

Public School Code 1303.1-A — every school entity's bullying policy, prompt investigation, and notice to parents

The policy. Each school entity adopts a bullying and cyberbullying policy as part of its code of student conduct, setting disciplinary consequences and naming the staff person who receives reports.

Email

Investigation and notice. The policy requires every incident of alleged bullying or cyberbullying to be investigated promptly. Once the school determines bullying occurred, it notifies the parents or guardians of any student involved as soon as practicable.

Posted and reviewed. The policy is posted on the school entity's website, if any, in every classroom, and in each building, reviewed with students within ninety (90) days of adoption and at least once each school year, and reviewed by the entity every three (3) years.

Off campus. A school entity may define bullying to include acts outside the school setting if they meet the elements the section's definition sets.

Other sections of the same law, regulations, and the court's or school's own rules are not on this page. How it applies to a particular case is a question for a licensed Pennsylvania attorney.
