Clean Indoor Air Act 3 — no smoking in a public place, with the exceptions the section lists

The rule. Except as the section provides, an individual may not smoke in a public place. Nothing in the act stops an owner from prohibiting smoking on their property.

  • A private home, residence or vehicle, unless used at the time for child care, adult day care, or care of children in state or county custody.
  • Designated lodging rooms making up no more than 25% of the units, and full-service truck stops.
  • Tobacco shops, and certain tobacco businesses.
  • A drinking establishment, cigar bar or tobacco shop that has documented its exception with the department.
  • Designated areas of a casino gaming floor, never more than 50% of it.
  • A designated outdoor smoking area of a sports or recreational facility, theater or performance establishment.

Those are among the exceptions. A private club is excepted unless it is open to the public for a club event or leased for a private event that is not club sponsored.
