Working With A Record
18 Pa.C.S. 9125 — convictions considered only as they relate to suitability for the job, with written notice of a denial
Only as it relates. An employer that receives an applicant's criminal history record information may use it in deciding whether to hire only as the section allows: felony and misdemeanor convictions may be considered only to the extent they relate to the applicant's suitability for the position applied for.
Written notice. The employer notifies the applicant in writing if the decision not to hire is based in whole or in part on criminal history record information.
Federal rules on background check reports, and the jobs where a law requires a check, are set out elsewhere and are not on this page. Whether a particular employer followed the law is a question for the state's civil rights or labor agency, or a licensed Pennsylvania attorney.
