Notice To End A Tenancy

S.C. Code 27-40-770 — seven days for week to week, thirty for month to month

Written notice, by either side. Either the landlord or the tenant may end a week to week tenancy by written notice given at least seven days before the date it names, and a month to month tenancy by written notice given at least thirty days before that date.

If the tenant stays without the landlord's consent after the agreement expires or ends, the landlord may bring an action for possession, with attorney's fees if the holdover is not in good faith. A wilful holdover can cost up to three months' periodic rent or twice the actual damages, whichever is greater.

If the landlord consents to the tenant staying on, the tenancy continues on the terms the agreement section sets for a tenancy with no fixed term. Notice periods a written lease sets for its own end are not on this page. A particular notice is a question for a licensed South Carolina attorney.
