Renting The Lot, Owning The Home

S.C. Code 27-47-310 and S.C. Code 27-47-530 — a written lot agreement, thirty days' notice of new rent, and the grounds for eviction

A park owner who leases a space for a manufactured home gives the resident a written agreement stating its length, the lot and its size, the monthly rent, when and where it is paid, what the owner provides, the rules that can lead to eviction, every amount the resident pays, restrictions on pets, children, occupants and vehicles, and the notice needed to renew or end it.

Thirty days' notice of new rent. When a tenancy continues past its original term, the owner gives the resident notice at least thirty days before a new rental rate takes effect. During the agreement, no user fee may be added for a service that was included in the lot rent unless the rent goes down to match.

  • Not paying rent within five days of its due date.
  • Breaking the agreement or park rules and not fixing it within fourteen days of written notice.
  • Breaking laws on manufactured homes after written notice and a reasonable chance to fix it.
  • Repeated conduct that disturbs other residents, or conduct affecting their health, safety or welfare.
  • A knowingly false statement in the application or agreement, or the park being taken by eminent domain.

Those are among the grounds on which a park owner may evict. A writ of ejectment may not issue until ten days after a verdict for the owner, except for conduct affecting other residents' health or safety. A home left on the lot twenty days after an eviction may be sold at public auction.

A deposit comes back with itemized deductions within thirty days after the tenancy ends, and money wrongly withheld can be recovered three times over with attorney's fees. A particular eviction is a question for a licensed South Carolina attorney.
