The Bicycle With A Motor, And The Moped
S.C. Code 56-5-3520 and S.C. Code 56-2-3070 — a bicycle with a helper motor rides as a bicycle, and a moped tops out at thirty-five
A person riding a bicycle with a helper motor, as the Code defines one, is subject to every statute that applies to bicyclists.
A moped: thirty-five, and the right lane. A moped may not be driven faster than thirty-five miles per hour, or on a highway with a speed limit over fifty-five miles per hour except to cross it at an intersection. On a multilane highway it keeps to the farthest right lane unless turning left or that lane is unsafe.
A moped rider sits on its permanent seat, carries no more people than it was built for, and keeps its lights and headlight on whenever it runs. A rider under the age of twenty-one wears a helmet.
A moped violation is a misdemeanor with a fine of up to $200 or up to thirty days. Mopeds are registered and their drivers licensed under neighboring sections.
