Where Nobody May Smoke
S.C. Code 44-95-20 — schools, child care, health care and government buildings, elevators and buses, and a fine of ten to twenty-five dollars
- Public schools and preschools, and licensed child care facilities.
- Health care facilities, apart from designated employee break areas.
- Government buildings, apart from enclosed private offices and designated break areas.
- Elevators.
- Public transportation vehicles other than taxicabs.
- The arenas and auditoriums of public theaters and performing art centers.
- Buildings and the areas just outside them at a public college that its board has designated nonsmoking.
Those are the public indoor areas where it is unlawful to smoke or carry lighted smoking material, unless a smoking area is designated as the chapter allows.
Ten to twenty-five dollars. Violating the rule is a misdemeanor carrying a fine of not less than $10 nor more than $25.
Restaurants, bars and private workplaces are left to local ordinances and owners under this chapter. An employer may not take personnel action against an employee for using tobacco outside the workplace.
