A Stalking Protection Order
SDCL § 22-19A-8 — for stalking, an assault injury or a crime of violence, against anyone, for up to five years
A petition for a protection order lies against anyone, family or not, for stalking, physical injury from an assault, or a crime of violence, with an affidavit stating the specific facts. The clerk has standard forms.
Up to five years. If the court finds stalking by a preponderance of the evidence, it may restrain it and order other protection, for a fixed period of up to five years.
