SDCL § 32-20-13 — licensed as a motorcycle to use a public highway, and never on the interstate

An all-terrain vehicle with four or more wheels and an engine of two hundred cubic centimeters or more, or an electric one, or a two-wheel off-road vehicle of one hundred twenty cubic centimeters or more, may be licensed as a motorcycle for use on a public highway.

Before it is licensed, it meets the light, brake and accessory requirements that apply to motorcycles.

Not the interstate. A vehicle licensed this way may not be driven on the interstate highway system. Doing so is a Class 2 misdemeanor.

Golf carts and youth off-road vehicles fall outside the section. A particular vehicle is a question for a licensed South Dakota attorney.
