Disorderly Conduct
SDCL § 22-18-35 — fighting, unreasonable noise, disturbing a meeting or blocking traffic, a Class 2 misdemeanor
- Engaging in fighting or in violent or threatening behavior.
- Making unreasonable noise.
- Disturbing a lawful assembly or meeting without lawful authority.
- Obstructing vehicular or pedestrian traffic.
Each counts only where the person intentionally causes serious public inconvenience, annoyance or alarm, or creates a risk of it. Disorderly conduct is a Class 2 misdemeanor.
The fourth time. After three or more convictions or guilty pleas within the preceding ten years, any fourth or subsequent offense is a Class 1 misdemeanor.
Cities have ordinances of their own. A particular charge is a question for a licensed South Dakota attorney.
