SDCL § 34-20G-2 — a cardholder within the allowable amount is not arrested, prosecuted or penalized
The cardholder. A cardholder is not subject to arrest, prosecution or penalty of any kind, or the denial of any right or privilege, for the medical use of cannabis within the allowable amount, with any plant grown in an enclosed, locked facility or being transported.
- Three ounces of cannabis or less.
- The cannabis products the department's rules allow.
- With a card allowing cultivation, two flowering plants and two that are not flowering.
That is the allowable amount.
Outside the card, the possession law applies. A particular case is a question for a licensed South Dakota attorney.
