SDCL § 22-19A-1 — following, credible threats or repeated harassing messages, a Class 1 misdemeanor, and a felony the second time in ten years

  • Willfully, maliciously and repeatedly following or harassing another person.
  • Making a credible threat meant to put someone in reasonable fear of death or great bodily injury.
  • Willfully, maliciously and repeatedly harassing by verbal, electronic, digital or written communication.

Each is stalking, a Class 1 misdemeanor. A second conviction within ten years of the first is a Class 6 felony.
