Alcohol Under 21
Utah Code 32B-4-409 — buying, having, drinking, or alcohol in the body
A minor may not buy or try to buy an alcoholic product, ask someone else to buy one, possess or consume one, or have a measurable blood, breath or urine alcohol concentration in the body, unless the alcohol title specifically allows it.
Who handles this in Utah: legal aid programs and the state offices, listed in the Utah directory.
- Misrepresenting a minor's age to get alcohol is unlawful, for the minor and for anyone else.
- A minor may not possess or drink alcohol in a limousine or chartered bus.
- On a first violation a court may order a screening, an assessment and an educational series or treatment; on a second it orders them.
For a minor at least 18 and younger than 21, the court suspends driving privileges, and may reduce the suspension on a first violation for completing an educational series or real progress in treatment.
