Driving While Suspended
Va. Code 46.2-301 — a Class 1 misdemeanor, and the same suspension again
In Virginia, driving a motor vehicle on a highway while one's license or privilege to drive is suspended or revoked, or after being directed by a court or the Commissioner not to drive, is a Class 1 misdemeanor, until the suspension ends, the privilege is reinstated, or a restricted license is issued.
The court suspends the license again for the same period. On a violation, the court suspends the license for the same period it had been suspended or revoked, or, where that period was not definite, for up to 90 more days. No such suspension runs beyond 10 years from the conviction date, except where another article requires it.
Where the suspension was for DUI or a related offense, a vehicle already impounded administratively may be held up to 90 more days on conviction, at the driver's cost, if the driver owned it.
