Va. Code 18.2-465.1 — no firing or forced leave for jury duty, and a Class 3 misdemeanor for an employer who does
No discharge, no forced leave. A Virginia employee summoned for jury duty, or summoned or subpoenaed to appear in court other than as a criminal defendant, may not be discharged, have adverse personnel action taken, or be required to use sick leave or vacation for the absence, after giving the employer reasonable notice.
A person who appears for jury duty for four or more hours in a day, travel included, cannot be required to start a shift beginning on or after 5:00 p.m. that day or before 3:00 a.m. the next day. An employer who violates the section is guilty of a Class 3 misdemeanor.
