A person 21 or older may grow up to four marijuana plants for personal use at their main residence, and no household may have more than four. The plants may not be visible from a public way, are kept by reasonable precautions from people under 21, and each carries a tag with the grower's name and license or ID number.
Knowingly or intentionally possessing a controlled substance without a valid prescription is unlawful. It is a Class 5 felony for a Schedule I or II substance, and a misdemeanor for the lower schedules: Class 1 for Schedule III, Class 2 for IV, Class 3 for V, and Class 4 for VI. Owning or occupying the place or vehicle where the substance was found does not by itself create a presumption of possession.
