A Small Estate
RCW 11.62.010 — personal property by affidavit after forty days, when the estate is one hundred thousand dollars or less
In Washington, any time after forty days from a death, a person who owes the person who died money, or holds their personal property subject to probate, pays or delivers it to someone claiming to be a successor, on proof of death and an affidavit stating what the section lists.
- The person who died lived in Washington.
- The whole estate subject to probate, apart from the spouse's or partner's community share and less liens, is no more than one hundred thousand dollars.
- No application for a personal representative is pending or has been granted anywhere, and all debts, funeral and burial expenses included, have been paid or provided for.
- Written notice of the claim went to every other successor at least ten days before.
A copy of the affidavit goes to the Department of Social and Health Services' office of financial recovery.
