RCW 10.21.050 — what the judicial officer weighs in setting conditions of release

In Washington, in deciding whether there are conditions of release that will reasonably assure the safety of other people and the community, the judicial officer in any felony, misdemeanor or gross misdemeanor case takes into account the information available about the following.

  • The nature and circumstances of the offense, including whether it is a crime of violence, and the weight of the evidence.
  • The defendant's character, health, family ties, employment, financial resources, length of residence and community ties.
  • Past conduct, any drug or alcohol history, criminal history, and record of appearing in court.
  • Whether the defendant was on supervision, probation, parole or release at the time, and the danger release would pose.
  • The defendant's firearms history.
