The Form That Comes With The House
RCW 64.06.030 — the disclosure statement after acceptance, and three business days to accept it or rescind
In Washington, unless the buyer has expressly waived it, the seller delivers a completed, signed and dated real property transfer disclosure statement not later than five business days after mutual acceptance of the purchase agreement, or as otherwise agreed.
Three business days. Within three business days of receiving it, or as otherwise agreed, the buyer either approves and accepts the statement or rescinds the agreement at the buyer's sole discretion, by written notice to the seller, and gets the deposits back. Without a rescission notice in that period, the statement is deemed approved.
Liability. The seller is not liable for an error the seller had no actual knowledge of, or one based on a public agency or a licensed professional's report. Apart from that, the chapter does not take away a buyer's other rights or remedies, and creates no new one beyond rescission.
The statutory form itself is in a separate section, amended with a later effective date, and is not on this page. Fraud and misrepresentation claims outside the disclosure law are not on this page. Whether a particular defect had to be disclosed, and what a buyer or seller can recover, are questions for a licensed Washington attorney.
