RCW 46.61.503 — 0.02 alcohol or any THC within two hours, a misdemeanor

0.02 alcohol, or THC above 0.00. A person under twenty-one in Washington commits a misdemeanor by driving or being in physical control of a vehicle with, within two hours after, an alcohol concentration of at least 0.02, or a THC concentration above 0.00, but below the adult limits.

It is a defense, proven by the driver, that the drinking or consumption happened after driving. No one is convicted for physical control if they moved the vehicle safely off the road before being pursued.
