Brandishing
W. Va. Code § 61-7-11 — a weapon used to threaten a breach of the peace, and wanton endangerment with a firearm
Licensed or not. It is unlawful for anyone armed with a firearm or other deadly weapon, licensed or not, to carry, brandish or use it in a way that causes or threatens a breach of the peace.
Brandishing is a misdemeanor, with a fine of not less than $50 nor more than $1,000, or jail of not less than ninety days nor more than one year, or both.
Wanton endangerment. Wantonly doing any act with a firearm that creates a substantial risk of death or serious bodily injury to another is a felony, with not less than one year nor more than five years.
The court may instead impose jail of not more than one year or a fine for wanton endangerment. A particular charge is a question for a licensed West Virginia attorney.
