Jury Duty And Your Job
W. Va. Code § 52-3-1 — no firing or threatening an employee for a jury summons
An employee discriminated against for getting a jury summons, responding to one, or serving on a jury may sue the employer in circuit court.
Reinstatement and back pay. If the employer fired or threatened to fire the employee, or cut pay for time they were not actually away, the court may order it stopped and reinstate the employee with or without back pay.
An employer does not have to pay wages for the time actually spent away on jury service. A particular claim is a question for a licensed West Virginia attorney.
