W. Va. Code § 60-3A-24 — buying, drinking or holding liquor or beer under twenty-one
Liquor or beer. A person under the age of twenty-one who purchases, consumes, sells, serves or possesses alcoholic liquor, or nonintoxicating beer, is guilty of a misdemeanor.
The penalty is a fine not to exceed $500 or jail for not more than seventy-two hours, or both, or for a first offense, probation for not more than one year instead.
A person at least eighteen may sell and serve alcohol in the lawful employment of a licensee.
