Under 21 And Driving
W. Va. Code § 17C-5-2 — two hundredths for a driver under twenty-one, and a roadside breath test
Two hundredths. A person under the age of 21 who drives with an alcohol concentration of two hundredths of one percent or more, but less than eight hundredths, commits a misdemeanor, with a fine of not less than $25 nor more than $100 for a first offense, and a license suspension.
An officer with reason to believe a person has been driving under the influence may require a preliminary breath analysis, given as soon as possible, and its result is used only to decide whether to arrest.
At eight hundredths or more, a driver under 21 is charged under the adult section. A particular charge is a question for a licensed West Virginia attorney.
