Calling For An Overdose
Wis. Stat. 961.443 — an aider is immune from possession charges
In Wisconsin, an aider is immune from prosecution for possessing a controlled substance, drug paraphernalia or a masking agent, under the circumstances surrounding or leading to the act of helping.
- Bringing someone who is, or reasonably seems to be, overdosing to an emergency room, hospital, fire station or other health care facility and contacting staff there.
- Summoning and contacting police, an ambulance or a health care provider to help them.
- Calling 911, or where it is not available an emergency medical service, and reaching someone, to get them help.
